Terms of Service

Welcome to travflex. These Terms of Service ("Terms") govern your access to and use of the travflex platform, website, and services (collectively, the "Service") provided by travflex Technologies ("travflex," "we," "us," or "our").

By accessing or using the Service, you agree to be bound by these Terms. If you are using the Service on behalf of an organisation, you represent that you have the authority to bind that organisation to these Terms.

1. Account Registration

• You must provide accurate and complete information when creating your account.
• You are responsible for maintaining the confidentiality of your login credentials.
• You must be at least 18 years old and legally capable of entering into binding agreements.
• You agree to notify us immediately of any unauthorised use of your account.

2. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not:

• Use the Service for any fraudulent, illegal, or unauthorised purpose.
• Attempt to gain unauthorised access to any part of the Service or its related systems.
• Interfere with, disrupt, or overload the Service or its infrastructure.
• Transmit malware, viruses, or any harmful code through the Service.
• Reverse engineer, decompile, or attempt to extract the source code of the Service.
• Resell, sublicense, or redistribute the Service without our written consent.

3. Your Data

You retain full ownership of all data you enter into the travflex CRM, including enquiry records, client information, booking details, documents, and financial data.

• We will not access, use, or share your data except as necessary to provide the Service or as required by law.
• You can export or delete your data at any time from your account settings.
• Upon account deletion, your data is removed within 30 days (see our Privacy Policy for exceptions).

4. Payment Terms

• travflex offers a free tier with core features available to all registered agencies.
• Paid plans, if applicable, are billed in advance on a monthly or annual basis.
• All fees are non-refundable except where required by applicable law.
• We reserve the right to change pricing with 30 days' written notice.
• Overdue payments may result in suspension of your account after a 7-day grace period.

5. Intellectual Property

The Service, including its design, code, features, logos, and documentation, is the intellectual property of travflex Technologies and is protected by copyright, trademark, and other laws. These Terms do not grant you any rights to use our trademarks, logos, or brand assets without prior written consent.

6. Service Availability

We strive to maintain 99.9% uptime but do not guarantee uninterrupted access. We may temporarily suspend the Service for maintenance, updates, or emergencies with reasonable notice. We are not liable for any downtime or data loss resulting from scheduled or unscheduled maintenance.

7. Limitation of Liability

To the maximum extent permitted by law:

• The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied.
• travflex shall not be liable for any indirect, incidental, special, consequential, or punitive damages.
• Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

8. Termination

Either party may terminate this agreement:

• By you: You may delete your account at any time from your account settings or by contacting support.
• By us: We may suspend or terminate your account if you violate these Terms, with notice and a reasonable cure period where applicable.

Upon termination, your right to use the Service ceases immediately. We will make your data available for export for 30 days following termination.

9. Governing Law & Disputes

These Terms are governed by the laws of India. Any disputes arising from or relating to these Terms or the Service shall first be resolved through good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to the exclusive jurisdiction of the courts in Bengaluru, India.

10. Changes to These Terms

We may revise these Terms from time to time. Material changes will be communicated via email or an in-app notification at least 30 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
